Someone stole my phone and I can't track it with find my iphone.

Did you turn on Find My [Device] before the phone was lost? If YES then he can try and find it through iCLOUD by going to this website https://www.icloud.com/find
If Find My [Device] was not turned ON before the iPhone was lost then there is nothing you can do about it but look for it physically.
Furthermore, your stolen iPhone must maintain connection to the internet via Wi-Fi or Cellular. As you know, this will only work until the batteries are exhausted.
