i need to recover my iPod . the top botton not working .

Hi my iPod is cracked and I want to know what the warranty cover and how many times and for how long and also if you could it would be great if you could call my moms phone so we can possibly set up an appointment because you can’t get in without one and just to let you know this is the worst of the newest iPods

Warranty covers manufacturing defects, not cracked screens or casing - unless it can be established (by Apple) that it was a manufacturing defect that caused the crack. Note the bit in brackets; Apple will be the one to decide whether it was a manufacturing defect, not the customer.

Luckily, you did not put your mum's phone number into your post. If you post again, do not include any personal information - not even someone else's phone number. Although it will eventually be removed, it is likely to cause you problems.

Unfortunately if iPod’s Sleep/Wake button is not working then you cannot restore it to factory settings.
