iPhone 6 in Activation Lock

My father passed away and I have his iPhone 6 and do not know his Apple ID or password. I thought that I had completely erased it but it is now in Activation Lock. Is there a way to resurrect it without the ID/PW? I do not want any of the data on the device, just a complete erase. Thanks.

Thanks but I will just discard the device before getting a court order. Again I do not want access to anything currently on the device.
