Apple Watch still has activation lock from previous owner
We bought an Apple Watch from a seller on eBay and they are still signed into the Apple of how do we remove this

Sure. No, that is not normal. It sounds like the charger is not making good contact with the Watch. Make sure the back of the watch is clean, and for the charging puck, make sure there is no plastic on the part that would contact the Watch. Contact the seller and ask them to follow all these steps;
Just for your information, a factory reset on the Watch will not remove Activation Lock. The same for Activation Lock on the iPhone or iPad as well. Activation Lock can only be removed by the owner that put it on there.
I have checked the plastic and there is nothing on the charger maybe I should clean the back of the watch
and another question when I press and hold the side button and the dial the watch doesn’t come up with the apple logo at all

Well, it would seem it probably isn't charged well. You can try a reset of the watch, hold the digital crown and the power button together until you see the Apple logo and release. Other than that, it would require Apple Support.
They won’t answer us
Then there is nothing that you can do about the Watch except to file a claim with eBay for a refund. You will not be able to activate the Watch.
