What about if I bought it secondhand and the seller refuses to take it off their iCloud account

Then return it and get your money back,the watch is of no use to you.

How can you take off an activation lock? I just bought this used series 1 apple watch and as I am trying to set it up, the activation lock is still set to the previous owners icloud/apple ID and I asked them about it and they replied saying that they had takin it off of there account. I was wondering if you could take off the activation lock so I could finish setting it up.
