Please verify the iPod model you have. link-> Identify your iPod model - Apple Support

A first generation iPod touch maxes out at iOS 3.1.3. No way for it to be running iOS 4.

A Second Generation iPod touch can run up to iOS 4.2.1 it can be updated from Settings->General->Software update or using iTunes / Finder on a computer.

Follow the steps in the support document you posted from to update it.
