If you can't back up the nano, how can you move the songs to a new device

Thanks for coming to Apple Support Communities for help today with getting songs from an iPod nano to a new device.
There isn't a way to sync music from an iPod to a new device or even back to a computer. You will need to have access to the music library you synced the nano with and then sync the new device to that library.
