I don’t have “photo stream” in my albums, does that mean all my photos are safe on my phone and won’t be deleted?

If you don't have a My Photo Stream album on any of your Apple devices in the locations shown in Information about the My Photo Stream shutdown - Apple Support then you aren't affected by the shutdown.
