In volume control the only way to have my remote control the volume was to select TV via IR, as of the latest update it appears that option is no longer available. What should I do?

Do you use the Siri Remote? If so, which model? Identify your Apple TV remote - Apple Support
Not sure why that option is not available to you. It is available to other users, including me, on tvOS 17.0.
Try a restart of the Apple TV box through Settings﹥System﹥Restart.
If the issue persists after that, then please contact the Apple Support staff for further assistance.
