The System requirements for using the various features in iCloud are available online:.

Eg: says:
iCloud1 requires an Apple Account, an active internet connection, and up-to-date software.
the minimum requirements for each feature are also all listed.
You can check which features your iOS version can access and use
Seems those using earlier iOS versions are all unable to accept the new T&C.
Yet Apple allows for continuing to use iCloud without accepting the T&C.
