Are you seeing activation lock? If yes, to make a long story short, you'll need to (1) recover the needed password from the person that last set you device up; (2) have, or recover, your own password for the device; (3) present your original purchase receipt for a pertinent device from an authorized Apple seller with the device’s serial number on it to Apple Support; or (4) have a court order instructing Apple to assist in the provision of access to a decedent’s information from the deceased person's accounts.
