How to migrate data from mid-2009 Macbook Pro (El Capitan) to 2020 Macbook Air (M1)

I would like to move all my data from my 2009 Macbook pro to my new Macbook Air, but I am concerned that this may cause the El Cap 10.11.6 OS to be installed on the new computer. Will (can?) Migration Assistant migrate data without also installing the old OS?

My preferred method of installation is from a Time Machine backup, as this is currently on a drive that will allow faster transfer speeds than my USB1-equipped Macbook Pro.

Hi Lowtones1,


When you are setting up the new M1 using Setup Assistant, it will ask you to transfer. This will not move the Mac OS version, only your content from the 09' Mac.
