Formatting the Disk:
Use: Shift-Option-⌘-R to format the macOS that came with your Mac, or the closest version still available. Go Here:
Should this product require access, as part of an estate or property, left a survivor;
matters such as legal status of the intended owner, needs clarification. This might
require one to provide documentation to Apple store manager, or other authority
as to the status and legal standing, in the jurisdiction the transaction is taking place.
If this situation is similar to yours, contact an Apple store, talk to manager, and ask.
An in-person meeting would likely be required; with items to support your claim.
They should have a short list of documentation you would be required to bring in
& otherwise provide; bill of sale, proof of your relation & copy of death certificate?
The product would require unlocking, if owner deceased, and/or is incapacitated.
This may require legal authority, or may be relatively simple; it could take months.
If the password & access is not so encumbered, a relatively easy path to reset exists.
(When my elder parent passed, valued assets were pre-divided among 2 older siblings.
With an executor or personal representative over an estate ~ maybe they could help.)

Note:
To associate his to your own Apple Account, he needs to sign out of iCloud on it, and disassociate it from his account. Elsewise, it is useless to you. So, be certain he does so, if he has not already.
