Activation Lock is intended as a theft deterrent, and a lock that was easy to bypass wouldn’t be a deterrent.
How? With the Apple ID and password holding the Activation lock, or with the original purchase receipt and matching photo ID and a discussion with Apple.

The seller can release the lock remotely via iCloud, if they choose.
