Is this a used device? If so, have the person signed in to it, sigh themselves out of it. Elsewise, it is useless to you. So, have the seller use this page prior to selling it to you: What to do Before you Sell, Give Away, or Trade in your iPhone, iPad, or iPod touch - Apple Support. Then, request that you log into it, prior to purchasing the item. If the seller decides to disabide by those rules you've se forth, the do no proceed with the transaction.
