It died before I got home and when I charged it and turned it back on this is what it says quick start if u have an iPhone or iPad running ios11 or later bring it nearby to sign in automatically.
If u want u can also set up this iPod touch manually

It wouldn't matter when it locked, it was never released from the owner. Return it.
Unless the website you bought it through offers buyer protection, yes.
Units don't lock themselves; this generally means the seller didn't or couldn't remove the lock.
