Powerbeats Pro Warranty issues

In November, while still under warranty, I sent my Powerbeats in to apple repair becuase my right head phone was not connecting because it kept having no charge. It could be at 100% the night before and that morning it would be 12%. They sent them back to me saying "the is nothing wrong" so I think, ok it must be a me issue that is the problem. Now in January, currently out of warranty, I went back to Apple because it kept happening and I have tried everything to fix it. Turns out there is something wrong but because it is out of warranty I would need to pay for the repairs. I spoke to several people who told me "oh yea for something that this it would be really easy for them to repair them for free because it was a fault on their end. I ended up speaking with the highest level of support person and told them that this should have been something they found the first time I sent them in and they missed it. Right? Turns out there is nothing that they can do and that I need to pay $100-$200 to have them repaired.


Is there anything else that I can do? It seems weird that they wouldn't cover it because they missed it the first time.
