Apple Watch activation lock

Spoke with Apple today as my brand new apple watch brought through online John Lewis, has activation lock when I try to pair it. I have not tried to pair with my account as I cannot get past the activation Lock Screen. They have told me to take back to John Lewis and explain the problem. Has anyone else out there had this issue with a brand new watch brought from a reputable high street store? Thank you
