I cannot factory reset my HomePod mini when I try I get "error "(-39). any ideas?

What reset method are you using? See Reset HomePod - Apple Support. I would normally use the Press the top of HomePod to reset it method, which I cannot see offers much scope for an error message, at least not until you start setting it up again.
