'Empty Trash' greyed out despite files being in the trash

I'm using a new, one week old MacBook Pro M1 Pro running the latest version of Monterey - I keep running into an issue where I'll put items in the trash but 'Empty Trash' is greyed out and the trash icon will not show as full, but clicking on the trash icon shows that there are files in it. Restarting the computer will temporarily resolve this, but it keeps happening not long after restart. Very frustrating for such basic functionality to be giving me consistent issues on such a new machine - any help would be much appreciated!

Restart in Safe Mode followed by a normal restart.

Try enabling or disabling automatic emptying of the bin every 30 days. About This Mac > Storage > Manage
