Trade ins and sales tax.

In Massachusetts we have sales and use tax. When I purchased my iPhone 13 Pro Max I payed $66ish for tax 6.25% on $1099. Ow they offer to let me trade my flawless iPhone 13promax in and get the iPhone 14 pro max for basically the exact same price but they want an additional $66ish dollars on top of my apple care etc.


I just feel uncomfortable or cheated to have paid for what is usually considered a lifetime sales and use tax as you only pay it once. I can’t sell it and charge 6.25% to a private party but I can box it up and lose that money as well as the merchandise o paid the tax on. If I returned the phone I would get my tax back. Why wouldn’t they prorate the same tax and deduct it from the new phones tax. I don’t know why. It it seems like common sense.


I filed a complained with DOR and the AG office but I really feel like this is a cheat

I had another look at the original post, and sounds something like the lifetime "trade-in policy with certain cellular service providers. But in that case the terms likely say that the customer is still responsible for all sales tax. I remember that as far back as getting my first subsidized cell phone where it was supposed $99, but I had to pay sales tax on the full $600 retail value.

Go complain to your State representatives. Apple has no control over taxes.


Count yourself lucky, the sales tax in Cuyahoga County, Ohio is 8.5%, though it varies a little by county.


If you don't like it, go to a state with no sales tax. Alaska, Delaware, Montana, New Hampshire, and Oregon are the five states that have no sales tax. That doesn't mean that municipalities don't have a sales tax...

I typically upgrade every year. And as far as I remember, I pay the sales tax on the full price of the new iPhone, and my trade is used towards the total I owe. I have every confidence, Apple is doing what is required in my State. I can't comment on other states as tax rates and policies vary by state. I have every confidence Apple does what is correct tax wise in every state they sell devices.

i know this is stated as automotive sales but like I said only a few higher dollar items have the ability to be traded in and the difference is computed lowering the sales tax on the newer vehicle. Should be the same for phones. I only posted this here because there isn’t exactly a place to question the fleecing of America by cellphone dealers so here we are!


That doesn’t mention anything about trading In the same type of equipment that has already been taxed. It shouldn’t be any different than an automobile. There aren’t many items that you are given the option to trade something in that has already been paid.

It’s not a trade in off the purchase price. It’s the difference between the tax you already paid on a 1000 piece of equipment that you are only getting a fraction of in trade. You already paid the sales tax on it when you fade in a car it’s the same thing. Except you shouldn’t have to pay sales tax again in it you already paid! It’s double dipping however you look at it. If the new phone is $1000 to make the math easier and you buy it outright no trade your tax in Massachusetts would be 62.50. If you trade in a comparable phone you already paid sale tax on that purchase. They are giving gym day $350 in trade flat out you still lose the entire $62.50 you already paid. They are supposed to pro rate the tax based on the trade value so $350 the residual tax is $21.87. That number should be deducted from the new ohones $62.50-$21.87=$40.63. How can you pay sales tax twice if the value your trade.
