Iphone locked to owner

So, I'm stucked because my brother bought a gift for me second hand iphone for me in 500$ NZ from Facebook marketplace and there is icloud locked 😞😞🤕🙏help what should I do know, my brother is very humble and even very polite he doesn't know about any this type of fraud **** thing,

I believe that, my brother is not thief or anything else he is very decent so could apple care help me , the seller is fraud so he got cheated. What should I do know please help me my brother is innocent so I didn't used any type of 3rd party or anything any type of illegal things so please help me 🙏

If you have bought 2nd hand iPhone, you must contact the seller (hopefully it is the previous owner), otherwise you have been scammed.

Each Apple device is linked/associated with an Apple ID of the person who did the setup.

Activation Lock prevents anyone who is not the owner from using this iPhone.

To unlock the Phone, you need the Apple ID and password of the previous owner, that were used during set up.

So you have to contact the previous owner.

 

The previous owner has to read -> this Apple article: What to do before you sell, give away, or trade in your iPhone, iPad, or iPod touch -> What to do before you sell, give away, or trade in your iPhone or iPad - Apple Support


Then the previous owner has to remove the iPhone from his account, see this Apple article:

Check your Apple ID device list to see where you're signed in

Check your Apple ID device list to find where you're signed in - Apple Support

 

Then you can sign in with your own Apple ID.

You have to show proof of ownership of your product, provide all documentation showing your purchase of the device.

If you do not have additional proof of ownership, contact the reseller. They may be able to provide the original purchase document.

Once Apple receive your proof of ownership, Apple will further review your request and provide an update.

Ask your money back if possible, perhaps you have bought a stolen iPhone.

If you can't get in touch with the previous owner, you can't use the iPhone, recycle the iPhone.

Sometimes the true owner of a lost or stolen phone will tell the phone to display a message with contact details. Sometimes not – often for personal security reasons. It sounds like in your case, they did not.


If the phone is not displaying contact details, and the person or company who sold the phone to your brother is not willing or able to help find the owner, that Activation-Locked phone will always be a brick. Apple will not help you to remove the Activation Lock or to find the owner.


Furthermore, if the phone is stolen, the true owner may have reported the theft to their phone company (carrier) and asked the phone company to blacklist the phone's IMEI (unique identifier). Apple does not have any control over blacklisting; but to the extent that a stolen phone is blacklisted, and the extent that carriers share blacklists, that phone will never receive cellular voice, text message, or data service ever again. Carriers generally will not remove a phone from a blacklist without the sort of proof of original ownership that you do not have.
