Two download folders - identically named - one local; one in iCloud

I have two download folders identically named and when I do a download somehow the system seems to make a decision as to which folder the download will be directed to. In Safari preferences I have set the target for downloads as "download". So how is it that some downloads end up locally and others in iCloud?

MacBook Pro 13″, macOS 14.5

I would delete the folder in iCloud.

What you can do is in Finder, create a folder and name it what ever you want and drag it to iCloud using the Command key in the sidebar and stick it in iCloud. You won't be able to see it in iCloud, but if there are any files in the downloads folder you want to keep use the circle with three dots in it in to top right hand side of the file. Look for "Move to Folder" and move it to the folder you just uploaded to iCloud.

What ever you upload to iCloud is still on you computer, since iCloud Drive is a synchronization service. If you want to see the folder on your Mac goto /Users/yourname/Library/Mobile Documents/com-appie~CloudDocs
