Unable to restore apps on my Time machine backup

I have a new Mac M4 and no access to the old Mac as I trade-it in at the store. Now every time I try to restore the backup it won't due to not compatible with the latest software.

When you go to restore from a TM backup while using Setup Assistant or Migration Assistant, just make sure to unselect "Applications". See the picture in Step #7....the top item checked is "Applications", just uncheck that and you should be good. You will then just need to download & install the latest versions any third party apps you want to use.

That means I will not be able to recover data from my 3rd party apps ?

Your data is stored in the home user folder. Unchecking "Applications" just prevents the applications themselves from being transferred.

Depending on the format of the data, you may be able to use other apps to read that data or you will need a newer version of the same app compatible with your new system to read the data.
