I just bought a used 5th gen iPod touch, the iCloud account from the previous owner is still stuck and I don't have any contact from the previous owner, I bought it at a second hand shop

You bought a brick. Unless you can get the previous owner to sign out of their account all you can do with it is place it on the desk and look admiringly at it.
Return it to the store for a refund. They have not sold it in a sellable condition.
