The way I understand it, only those with up-to-date iOS versions are able to accept the new T & C.

Yet Apple allowed /still allows those with earlier software versions to continue their use of iCloud.

Some of the newer iCloud features also require up-to-date software / security. The article:

System requirements for iCloud - Apple Support shows which features can be used by which iOS. versions

(Eg: To use iCloud you need at least iOS 10 on iPhone 5)

My wife had the same problem for months in her iPhone X 2017 iOS 16.7.11 despite logging out/in iCloud and rebooting, or resetting iPhone settings. I was recently finally allowed to reset that iPhone to factory defaults (and restore from a local backup) and that fixed it.
