APPLE ID CHANGE ON NEW PHONE

So I got scammed. I bought on FB Marketplace what is supposed to be an iPhone X (256 gb) but what was mailed to me I think is either a 7 or 8. You can imagine how upset I am about this especially with no recourse. What's worse is that I cannot even activate it since the scum did not erase his Apple ID from the phone. I get no response from the multiple attempts to get a hold of him (Ryan James Souza from MA) How can I get his Apple ID removed from this phone considering I will not get my money back from him?

There is no known way to bypass activation lock without assistance of the previous owner. It is an anti-theft measure. See: Activation Lock for iPhone, iPad, and iPod touch - Apple Support
