Photo App does not allow deletion

When I select a photo to delete The trash can is not available, how do I delete uneditable photos?

One way to have photos on your iPad or iPhone that cannot be edited or deleted is if you pushed them there from a Mac using iTunes (old systems) or Finder (recent systems). Those can only be changed or removed by repeating the "sync" with a different set of photos (perhaps none at all).
