Apple pencil defect

I purchased my apple pencil 1st gen this February. Now, it simply refuses to connect to my iPad. Will I get a replacement?

Legal - Hardware Warranties - Apple

if they judge it's because of a production defect discovered after purchase and not user handling it should be covered
