If Find My was enabled on any of your brother's devices, they likely have Activation Lock enabled. This prevents them from being reused unless the original Apple ID and password are provided. Regarding your brother's Apple ID, Apple can provide you with direct access if your brother authorized you as a legacy contact, or if Apple receives an appropriate court order. You can also request that your brother's Apple ID be deleted if you have a valid death certificate for him.
